These Terms of Service govern finaldark.com and any purchase made from FINALDARK. FINALDARK is a brand and online storefront operated by SHIYA & CO, a Colorado profit corporation. By using the site, you agree to these terms and the policies linked from the footer. If you do not agree, do not use the site.

Store status and eligibility

The store is currently in a pre-launch stage and all inventory is zero. You must be legally capable of entering a binding agreement and must use the storefront lawfully. A parent or guardian must supervise use by a minor where required.

Product information and availability

We aim to describe products, materials, fit, colors, prices, and availability accurately. Displays and lighting can affect color. Product concepts may change before sales open. A listing is an invitation to place an order, not a guarantee of inventory or acceptance.

Orders and acceptance

An order is an offer to purchase. An automated acknowledgment does not by itself mean acceptance. We may verify inventory, payment authorization, address, quantity, pricing, fraud indicators, and legal restrictions before accepting. We may reject or cancel an order for a legitimate reason. Any captured payment for an unaccepted item will be voided or refunded.

Pricing, taxes, and payment

Prices are shown in the displayed currency and may change before an order is placed. Applicable taxes and shipping charges are shown at checkout. We may correct an obvious pricing or description error before acceptance and will obtain consent before charging a corrected higher amount. Only checkout payment methods are accepted.

Shipping, returns, and refunds

The Shipping Policy and Refund Policy form part of these terms. Mandatory consumer guarantees and cancellation rights in your location remain unaffected.

Accounts and communications

You are responsible for accurate account information and reasonable protection of login credentials. Notify us of suspected unauthorized use. Marketing consent is optional and can be withdrawn through an unsubscribe link; service communications about an account, request, or order may still be sent.

Acceptable use

Do not misuse the storefront, interfere with security, scrape or overload services, introduce malicious code, impersonate another person, infringe rights, use the site for fraud, or attempt unauthorized access. Reasonable use of product information for personal shopping is allowed.

Intellectual property

The FINALDARK name, site content, original product presentation, photographs, graphics, and other materials may be protected by intellectual-property law. No ownership transfers to a visitor. Third-party marks belong to their owners and do not imply affiliation.

Third-party services and links

Shopify, payment providers, carriers, and linked websites operate under their own terms and privacy practices. We are responsible for our own obligations but do not control an independent third party. Review third-party terms before using those services.

Disclaimers

To the maximum extent permitted by law, the site is provided on an "as available" basis and we do not guarantee uninterrupted or error-free access. We do not exclude warranties, guarantees, remedies, or liabilities that cannot lawfully be excluded. Product-specific warranties, if any, will be stated with the product.

Limitation of liability

To the maximum extent permitted by law, SHIYA & CO is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable. For a paid transaction, aggregate liability arising from that transaction will not exceed the amount paid for the affected product, except where a higher remedy or liability is required by law. These limits do not apply to fraud, willful misconduct, personal injury caused by negligence, or other liability that cannot lawfully be limited.

Governing law

Colorado law governs these terms, without excluding mandatory consumer protection law that applies where you live. Courts with lawful jurisdiction may hear disputes; nothing here prevents use of a government consumer-protection process or a remedy that cannot be waived.

Changes and severability

We may update these terms prospectively. The posted date identifies the current version. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue.
